In a deeply troubling act of violence that has sent shockwaves through the South African legal community, Regional Court Prosecutor Tracy Brown was assassinated outside her home in Young Park, Gqeberha, on Thursday afternoon. The National Prosecuting Authority (NPA) has confirmed her identity and described the murder as a brazen, execution-style killing.

Brown was attacked in broad daylight by four masked assailants travelling in a white VW Polo. She had just returned home and was still seated in her Toyota Etios when she was ambushed. Despite being rushed to hospital, she succumbed to multiple gunshot wounds. The horrific act unfolded in the presence of her partner and minor child, making it not only a calculated killing but a profoundly cruel one.



This is not an isolated incident. Brown is the second prosecutor in the Eastern Cape to be murdered in recent months. In April, Elona Sombulula, a 30-year-old prosecutor at the Ngcobo Magistrate’s Court, was fatally shot near his home outside Mthatha. The motive for both killings remains unclear, but the trend is unmistakable—and deeply disturbing.

The NPA has described these murders as “an attack on the rule of law”. National Spokesperson Mthunzi Mhaga said: “Our prosecutors take on their duties with courage and a deep commitment to serving the people, often at great personal risk. To target those who dedicate their lives to upholding the law is to strike at the heart of our constitutional democracy.” He assured the public that law enforcement, in conjunction with the NPA, will leave no stone unturned in the search for the perpetrators.

Minister of Justice and Constitutional Development, Mmamoloko Kubayi, expressed her horror at the killing, stating she is “deeply disturbed” by the continued targeting of court officials. She highlighted the need to urgently review and reinforce protective measures for prosecutors, particularly in high-risk areas like the Eastern Cape. “Government remains committed to ensuring those who serve the justice system are protected, and acts of violence against them are met with the full might of the law,” she said.

While the NPA already has employee assistance and close protection policies in place, Kubayi admitted recent incidents revealed gaps in implementation. She called for better coordination among security cluster stakeholders to ensure meaningful protections are enforced.

The murder of prosecutors highlights a broader crisis within the criminal justice system. Prosecutors not only contend with heavy caseloads and resource shortages but now also face direct threats to their lives. This compounds an already stressed justice infrastructure and raises grave concerns about the safety and sustainability of legal service in vulnerable communities.
